Vincent Avery is a founding Member of Avery Law, LLC. As an employment attorney for over a decade, Mr. Avery defends employers across all industry sectors, focusing on two highly regulated industry ripe for litigation -- home health care and hospitality -- in state and federal court. He also provides advice and counsel, working closely with in-house counsel and business owners to either mitigate or prevail in litigation.
Mr. Avery also represents employers in both individual and class-based wage and hour litigation under the FLSA, New York Labor Law, New York Hospitality Wage Order, and New Jersey Wage and Hour Law. Mr. Avery also represents employers against single and multi-plaintiff discrimination and retaliation claims asserted under state and federal employment statues.
He also regularly represents employers in both alternative dispute resolution proceedings, such as arbitration and mediation, as well as administrative proceedings before the Department of Labor, EEOC, New York State Division of Human Rights, and New Jersey Division of Civil Rights.
Mr. Avery routinely provides preventative advice and counsel to his clients to help them avoid litigation in wage and hour issues such as overtime pay, minimum wage issues, prevailing wage concerns, tip credit and service charge disputes, in addition to advising them on general employment matters related to discipline and termination, harassment training, internal investigations, and leave related issues arising under the FMLA, ADA and state and local statues.
His traditional labor experience is also extensive as he has handled collective bargaining, union elections, union-employer relations for clients, grievance arbitrations, and has represented companies before the NLRB.
Employers rely on Vince's aggressive approach to litigation. He has successfully defended more than two dozen clients in collective action litigation, and prevailed in more than a dozen trials. He is known for defeating class action certification in wage and hour cases at each stage, including the conditional certification phase of litigation, which saves his clients the cost and emotional toll of litigation. Home health care companies also rely on his experience for matters specific to the industry, such as wage parity matters.
He has been named an 8x Rising Star for New York by the New York Times, and 5x Rising Star for New Jersey by New Jersey Monthly Magazine.
